These Terms of Service (“Terms”) govern your use of middlefingercollective.com (the “Site”), operated by Middlefinger Collective (“we,” “us,” or “our”). By using the Site you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

1. Pre-launch status

The Site is currently a pre-launch preview. Products shown are “coming soon,” and nothing on the Site is an offer to sell or a commitment to sell or ship any product. You can’t place orders yet. Product availability, prices, colors, sizes, and details may change or be withdrawn at any time without notice. When ordering opens, we will post additional purchase terms (covering pricing, taxes, shipping, returns, and exchanges), which will apply to your orders.

2. Who may use the Site

You must be at least 13 years old to use the Site, and you must be at least 18 (or the age of majority where you live) to purchase products once ordering opens.

3. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or its networks;
• Use bots, scrapers, or other automated tools to access or collect content or data from the Site, other than standard search-engine indexing;
• Submit false information or an email address that isn’t yours, or use the waitlist form to send spam or abusive submissions; or
• Copy, modify, distribute, or use the Site’s content in a way that infringes our rights or anyone else’s.

4. Waitlist and email updates

By joining the waitlist, you confirm the email address is yours and you agree to receive emails from us about our launch, new products, and restocks. You can unsubscribe at any time using the link in our emails or by contacting us. Joining the waitlist does not reserve any product or guarantee availability, pricing, or early access.

5. Intellectual property and trademarks

The Site and its content — including text, photographs, graphics, product designs, and layout — are owned by or licensed to us and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, revocable license to view the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.

The Middlefinger Collective™ name, wordmark, and logo are trademarks of Middlefinger Collective (registration pending). Other names and marks that appear on the Site belong to their respective owners. Use of our marks without permission is prohibited.

6. Product information and images

We work to make product descriptions, images, and prices accurate, but we don’t guarantee they are complete or error-free. Colors may appear differently on your screen. During the pre-launch period, images and descriptions may include prototypes, samples, or illustrative imagery, and final products may differ. We may correct errors or update information at any time.

7. Third-party links

The Site may link to third-party websites or services, such as Instagram. We don’t control them and aren’t responsible for their content, policies, or practices.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions don’t allow certain warranty disclaimers, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, Middlefinger Collective and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend and indemnify us from third-party claims, and related losses and reasonable legal fees, arising from your violation of these Terms or of the law, or your infringement of another person’s rights.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. To the extent permitted by law, any dispute arising out of these Terms or your use of the Site must be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.

12. Changes and termination

We may change the Site or these Terms at any time. Updated Terms take effect when posted, and your continued use of the Site means you accept them. We may suspend or restrict access to the Site at any time, including for violations of these Terms.

13. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver of it. You may not assign these Terms without our consent; we may assign ours in connection with a sale or transfer of our business.
